(PM) — The American Civil Liberties Union and Planned Parenthood Federation of America file a federal lawsuit to prevent the State of Alabama from implementing its total abortion ban.
The lawsuit, filed today, seeks to block the near-total abortion ban before it can take effect.
Alabama’s law is the strictest anti-abortion law in the US, and threatens prosecution of doctors with felony charges and up to 99 years in prison for performing an abortion, with no exception for rape and incest. It allows abortions only if there is a serious or dangerous threat to the woman’s health.
In sum, the lawsuit argues that the ban flagrantly violates the Roe v. Wade ruling which abortion is legal. Supporters of the law hope to get to the Supreme Court and have Roe v. Wade overruled.
The complaint asks for an order declaring the ban unconstitutional and blocking it from being enforced.
States across the country have also enacted strict limits on abortion.
Alabama’s attorney general, Steven Marshall, who’s named as the lead defendant in the suit, did not immediately respond to a request for comment.
